A long-standing controversy has finally been put to rest as the New Jersey Department of Environmental Protection Commissioner, Shawn M. LaTourette, has ruled that the Ocean Grove Camp Meeting Association (OGCMA) can no longer restrict access to its private beach on Sunday mornings during the summer. But here's where it gets controversial - this decision has sparked debate about religious freedom and public access to beaches.
The OGCMA, a religious group, has been blocking access to the beach via the boardwalk entrance every Sunday morning since the summer season began, citing religious reasons. However, LaTourette's 39-page decision argues that the state's investment in the beach's replenishment and upgrades means the public has a right to access it.
"State law is clear: permit holders like OGCMA must provide public access to privately-owned beaches," LaTourette wrote. "The public's right to access outweighs OGCMA's claims of religious freedom in this case."
This ruling overturns an earlier decision by an administrative court judge who sided with OGCMA, allowing them to restrict beach access. The state Office of the Attorney General had appealed this decision, arguing that it violated the Coastal Area Facility Review Act.
The OGCMA has been at odds with local residents and the state over this issue for years. The group has also faced criticism for building a $2 million pier in the shape of a Christian cross, which has been partially closed due to structural concerns.
And this is the part most people miss - the OGCMA still controls the privately-owned boardwalk, despite Ocean Grove being part of Neptune. This raises questions about the balance between private property rights and public access.
